ELP 528SEM - Law and Higher Education


This course addresses the impact of laws, regulations, and judicial decisions on U.S. institutions of higher education. It will review the panoply of laws and legal concepts which apply to colleges and universities, their employees, faculty, and students. Our review of higher education law will include, among other issues: the legal nature of public and private universities; university governance; institutional liability; relationship with its faculty (e.g., tenure); academic freedom rights; student issues and rights, including discipline; affirmative action and civil rights; relations with federal, state, and local government; intellectual property; and athletics. Our goal, as higher education administrators, is to be able to identify and recognize these issues.
