LAW 778LEC - Cross-Border Dispute Resolution


When parties from different countries enter into contracts or engage in transactions, their resulting legal disputes pose challenges that are not present in the purely domestic context. Lawyers engaging in work on behalf of commercial clients need to know how to navigate these complexities, and this course will introduce the major issues and address how to approach them. Among other topics, the course will cover: the pros and cons of choosing to resolve cross-border disputes by arbitration or by litigation; issues particular to international litigation including establishing jurisdiction, service of process, and enforcement of judgments; and considerations relevant to international arbitration, including strategic decisions regarding what provisions to include in the arbitration agreement. The course will provide opportunities for practical hands-on learning, including the drafting and interpreting of arbitration clauses.
