LAW 941LEC - The Green Rush


Under federal law, cannabis remains a Schedule I substance, with no recognized therapeutic or medical use. Despite a ninety year prohibition, 33 states have now legalized medical marijuana, ten states and Washington, D.C. have passed legislation permitting recreational use, and almost two-thirds of Americans support federal legalization. This course will cover all facets of cannabis, from the plant and its scientific makeup, to the myriad ways governments have attempted to benefit from cannabis-derived revenues at federal, state and local levels. We will go in depth into the legislation, taxation and business of this budding industry. We will discuss hot topics in cannabis, including hemp, the CBD craze, and of course, section 280(E) of the Internal Revenue Code. Cannabis touches all areas of the law, including tax, business, employment, health care, elder law, criminal law, real estate, environmental, banking and finance, and international law. This course will analyze those connections and continue the dialogue surrounding the future of cannabis.
